AP US History 준비, 키워드를 분석하면 길이 보인다 (2)

 

기출 문제 풀이는 문제가 매년 똑같이 출제되기 때문이 아니라, 중요한 내용은 반복적으로, 다른 형태로 출제되기 때문에 중요하다. 가령 다음 예의 제시문은 단 두 줄. 그렇지만 이 문제를 제대로 공부한다는 것은 여러 가지 중요한 요점을 리뷰하는 과정을 포함해야 할 것이다.

 

Questions 1 - 4 refer to the excerpts below.
“We conclude that in the field of public education the doctrine of ‘separate but equal’ has no place. Separate educational facilities are inherently unequal.”

제시문은 유명한 <브라운 대 토피카 교육위원회 (Brown v. Board of Education of Topeka, 1954)>재판의 판결문이다. 이 판결에서 대법원은 “공립학교에서 흑백 인종 간의 분리 교육은 근본적으로 불평등”하기 때문에 위헌이라고 선언했다.

그런데 “공교육에서 분리되었으되 평등하다는 논리는 설 곳이 없다”는 문장은, 직접적으로 공공 시설과 교육에서의 인종 분리 정책이 수정 헌법 14조 (시민의 헌법적 정의와 법아래 동등한 권리를 명시) 위반하지 않는다고 주장한 1896년의 Plessy v. Ferguson 판결의 “분리되었으되 평등하다”는 원칙을 정면으로 공격하고 있다. 또한 이로써 브라운 판결은 1950년대와 60년대 흑인들의 민권운동에 기폭제 역할을 하게 된다.

위 문제는 그 결과를 질문하고 있다. 브라운 판결은 남부 백인들의 거센 반발에 직면하는데, (D) 에서 기술하다시피 흑백 통합교육에 반대하여 자녀를 사립학교로 전학을 시키는 현상들이 발생한다. 이와 같은 맥락에서 버지니아의 Massive Resistance와 리틀락 사건 등의 세부사항을 기억해두면 에세이를 쓸 경우에도 좋겠다.

수정헌법 14조에 따르면 시민들은 법 앞에 평등하다. 백인이건, 흑인이건 혹은 평범해보이는 시민이건 범죄 용의자이건 법의 적용이 차별적이어서는 안 된다. 적법 절차에 관한 판결로, 민권 운동과 무관해보이는 미란다 판결 역시 수정헌법 14조에 근거했다. 또한 1번과 4번 문제를 잘 관찰했다면 파악했겠지만 문제의 선택지에 포함되어 있지 않더라도, 건국부터 현재까지의 주요 대법원 판례들과 그 맥락, 결과, 중요성 등을 정리하는 학습이 꼭 필요하다.
